1. Purchase Contract
1.1 The trader with whom you conclude this purchase contract is Nestlé UK Ltd, “we”, “us” or “our” (registered in England and Wales with company registration number 51491) with registered office at 1 City Place, Gatwick, RH6 0PA and VAT registration number is GB 169562721.
1.2. By placing an order with us online or via telephone on 0800 00 00 30 (UK) you agree to be bound by these terms and conditions (“Conditions”) which shall apply to all items for sale via the same phone line (“the Phone Line”) and on our website at www.nestlebaby.co.uk (the “Website”) . If ordering by Phone Line, please have in mind that you will be or have already been informed of some of these Conditions during our phone conversation, as specified by relevant legislation and you will receive further written copy of them at the latest upon delivery of your order. Please read these Conditions carefully. You should print a copy of these Conditions for future reference. If you do not accept them and have ordered via the Phone Line, you must immediately cancel all orders. If you do not accept them for orders made via the Website, you will not be able to complete an order of any item/s.
1.3. By placing an order via the Phone Line or through the Website you warrant and represent that you are legally capable of entering into binding agreements and you are at least 18 years old.
1.4. An order placed by you is an offer and is only binding on us when we accept it. For orders made via the Website, we will confirm such acceptance (if any) by sending you an email that we have despatched your order, at which point a contract between us will be formed. Orders are only despatched when we have received cleared payment. For orders made via the Phone Line, we will confirm such acceptance (if any) by responding to you that we accept your order(s), at which point a contract between us will be formed and/or, if you choose to give us your consent to send you an email, by sending you an email stating that we have received your order and that we confirm it.
1.5. Bulk orders from the trade or consumer groups will not be accepted.
1.6. Title in the item/s shall remain with us until we have received cleared payment. The risk in the item is passed over when the goods are successfully delivered.
2.1. The items indicated as for sale via the Phone Line and/or the Website are available for sale at the sterling prices indicated on our website from time to time and provided to you over the phone if ordering via the Phone Line. These prices do not include VAT as these products are non-VATable and prices do not include postage and delivery to locations in the UK. See section 4) for Postage and delivery costs.
3. Method of Payment
3.1. Payments may be made by the following credit cards: Visa, Mastercard, and Maestro. We will not dispatch your order until we have received cleared funds from your account. If we are unable to charge your payment card you will be notified at the point of placing your order.
3.2. We reserve the right to terminate our agreement with you if we are refused authority for payment or reasonably believe that payment will be refused at any stage.
4.1. Delivery will be made to the address specified by you when you use our on-line shop on the Website or via the Phone Line, provided the address is within the UK.
4.2. If ordering via the Website, you have the ability to change this address during the confirmation stage at the checkout.
4.3. It is your responsibility to ensure you are available to receive the delivery. If you are not at the delivery address to receive the goods, a card with a contact number will be left for you to arrange with the courier an alternative drop off time or collection from a local depot. If redelivery or collection does not take place, the goods will be returned to “us” and you will be refunded the full value of the purchase, minus the delivery charge. From that point, if you still wish to receive your order, you will have to re-order via the Website or the Phone Line.
4.4. Products are subject to availability and prevailing market conditions. In the event of non-availability of any goods, this will be stated on the Website or explained to your over the Phone Line.
4.5. The minimum order quantity for CERELAC® is 3 tins. For any other product for sale on the Website, we will specify any minimum quantity at the time of your order. The cost of 3-5 day standard delivery for 3 or more tins is £1.00. The cost of 24 hour signed for delivery for 3 or more tins is £2.00. Delivery costs subject to change.
4.6. Where we accept an order, we will do our utmost to ensure that item/s is/are despatched within 3-5 working days of placing the order subject to availability of stock and receipt of clear funds, but please allow for up to 28 days.
4.7. We can only guarantee a next day delivery for orders received by midday on working days Monday through to Thursday. Weekend deliveries are not currently available. Orders placed at the weekend or after midday will be processed on the next working day and orders over the seasonal period may take longer.
5. Defective Goods
5.1. You must inspect the goods and notify us within 30 days of delivery in writing using our contact us form that can be found at https://www.nestle.co.uk/getintouch/emailme or by phoning our Consumer Services team on 0800 00 00 30 (UK),if for any reason you are unsatisfied. If the item you purchased is faulty, we will provide free return of said item(s) and may offer an exchange or refund as appropriate in accordance with your legal rights.
6. Amendment of Orders & Cancellation Rights
6.1. If you are contracting as a consumer, you may cancel your order at any time from the date of the order up until the date that is 14 working days from receipt of the item/s by calling our Consumer Services team on 0800 00 0030. In such case, if you cancel your order: a) before you have received the item/s, you are entitled to refuse to accept delivery of the item/s and we will refund to your account with a full refund within 14 days of your refusal to accept delivery of item/s or b) after you have received it/them, you must return the item/s to us in an undamaged and unused condition at your expense within 14 days of informing us of your cancellation and we will refund to your account with a full refund within 14 days of receiving the item/s back. This provision does not affect your statutory rights.

7.1. Save in respect of death or personal injury caused by our negligence, to the extent permitted under law our liability shall be limited to the purchase price of the item in question.
8.1. You are entirely responsible for all orders placed with us or information given to us under your e-mail address. You must immediately notify us of any unauthorised use of your e-mail address or any breach of security known to you.

9. Special Offers, Promotions & Competitions
9.1. From time to time, and, at our complete discretion, purchases of goods may be subject to special offers.
10.1. Applicable laws require that certain communications should be in writing. You agree that we may communicate with you by email, by posting notices on the Website or by writing to you at your postal address and accept (without affecting your statutory rights) that such communications comply with any legal requirements for any communications to be in writing.
10.2. Our agreement shall be governed by English law and the parties submit to the exclusive jurisdiction of the English courts.
10.3.vWe have the right to amend these Conditions from time to time. You will be subject to the terms and conditions in force at the time that you place on order, unless any change to such terms and conditions is required by law or government authority.
10.4. All notices given by you must be sent by post to our address Nestlé® Infant Nutrition Consumer returns department, Nestlé House, Haxby Rd, York, YO91 1XY.
10.5. Notices will be deemed received and properly served within 5 days of receipt by us. Notices may be posted in the Website, sent via email or through the post.
